At any time Guy Vernes may without notice make changes to this Site or to the products described in this Site. You may not otherwise use, modify, copy, print, display, reproduce, distribute, or publish any information from this Site without the express permission of Guy Vernes.
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, ‘look and feel’ and arrangement of such content, contained on the site is owned, controlled or licensed by Guy Vernes, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.
Except as expressly provided in these Terms of Use, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without Guy Vernes’s express prior written consent.
Information in this web site is provided “as is” without any express or implied warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Guy Vernes shall not be liable to any party for any compensatory, direct, indirect, consequential, incidental, special, exemplary, punitive or other damages with regard to the use of this web site or any other hyperlinked web sites. Guy Vernes does not promise that the site or any content, service or feature of the site will be error-free or uninterrupted, or that any defects will be corrected, or that your use of the site will provide specific results. Guy Vernes cannot ensure that any files or other data you download from the site will be free of viruses or contamination or destructive features. This section survives termination of this agreement.
Guy Vernes uses reasonable precautions to protect the privacy of your credit card and other ordering information by utilizing a Secure Socket Layer (“SSL”) connection. Accordingly, your credit card and other ordering information, such as your name and address, is encrypted using the SSL connection and is not expected to be read in an intelligible form as it travels to Guy Vernes order processing system. Guy Vernes order processing systems are not connected to the Internet and are not accessible to the public.
You agree to purchase the products ordered on the various order screens once you click on the “SUBMIT” or similar button on the product order screens. The terms of the purchase agreement include, without limitation, the information included on the various order screens and the terms of this section. Such purchase agreement is in addition to and not in lieu of the agreement into which you are deemed to have entered with Guy Vernes by virtue of your use of this site.
Neither Guy Vernes, nor its affiliates, nor the directors, officers, employees, or other representatives of any of them, is liable for any type or amount of damages arising out of or in connection with the use of the Products. This is a comprehensive limitation of liability that applies to all damages of any kind, including without limitation compensatory, direct, indirect, consequential, incidental, special, exemplary, or punitive damages; loss of data, income, or profit; loss of or damage to property; and any and all claims of third parties.
Products are shipped directly from the Netherlands. The shipping chart as displayed on the Site is only applicable when the purchased product is in stock. If the order is not delivered within 30 business days from the date Guy Vernes received the payment, you are entitled to cancel the order. Guy Vernes will refund your payment within 30 days.
After you place an order with Guy Vernes, you should receive an e-mail acknowledgement within one (1) business day to confirm that Guy Vernes has accepted your order and is processing it. The e-mail will contain the details of your order, together with the itemized and total amounts that will be billed, including all applicable taxes and charges. Furthermore, a receipt will be included with your purchase. Be sure to keep your receipt. You will need your original receipt if you require any warranty service.
All prices are stated and payable in Euros. The prices for products quoted on this Site include taxes, but do not include shipping costs. Guy Vernes charges all applicable Dutch taxes on all products. Shipping charges shall be at then-current rates and will be included in the charges to your purchase and are listed in the shipping rates list on the Site.
Guy Vernes is not liable for any action, including charges, taken by customs on your packaging during delivery.
If a package is returned because you did not claim or refused the reception of the package, Guy Vernes does not send replacements.
Products can be returned within 7 days after reception (Return Period). A product returned with proof of purchase to the place of purchase during the Return Period is eligible for a refund of the purchase price (less any and all rebates and shipping charges) if the product is (i) in unworn, unwashed and undamaged condition and (ii) accompanied by all (A) original packaging and (B) accessories and other contents that came or were ordered with the product. You may (in the exercise of our sole and reasonable discretion) be required to pay a restocking fee. Guy Vernes is not liable for lost packages during transport if you to choose to use an untraceable shipping method. Refund or credit to your account will be issued within 30 days.
Every order is thoroughly and extensively checked for damage before shipment. Guy Vernes is not liable for damage occurring after shipment (including transport damage).
Guy Vernes may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Guy Vernes’ rights or property, or the rights or property of visitors to or users of the Site, including Guy Vernes’ customers. Guy Vernes reserves the right at all times to disclose any information that Guy Vernes deems necessary to comply with any applicable law, regulation, legal process or governmental request. Guy Vernes also may disclose your information when Guy Vernes determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.
You agree that Guy Vernes may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site if we determine that you have violated these Terms or other agreements or guidelines which may be associated with your use of the Site.
We each agree that all matters relating to the use of the site, including all disputes arising out of these terms will be governed by the laws of the Netherlands (Dutch law).
We each agree that any and all claims or disputes between you and guy vernes in any way related to or concerning these terms and/or our products, including any billing disputes, will be resolved by the Dutch court.
For all disputes, whether pursued in court or arbitration, you must first give us an opportunity to resolve your claim by sending a written description of your claim to the address below. We each agree to negotiate with each other in good faith about your claim. If we do not resolve the claim within 60 days after we receive this claim description, you may pursue your claim by judicial means.
